  • Parental rights — In 2019, the Oklahoma Supreme Court recognized that non-biological LGBTQ+ parents who raise children born during a same-sex relationship have the same parental rights as parents who are biologically related to their children. However, you will need evidence to prove that you are your child’s parent if your name is not on the child’s birth certificate.

Among other criteria, the long-term couple must publicly present themselves as spouses even though they never obtained a marriage license. It can be tricky trying to determine what counts as marital property versus separate property if the couple had what amounted to a common law marriage before legally marrying. The total length of the marriage is also a factor used to determine if alimony will be granted and how much.
